LBS International Women’s Day 2021 Campaign (“Campaign”)!

The Campaign is organised by LBS Bina Group Berhad (hereinafter known as “the Organiser”). By participating in the Campaign, you agree to be bound by the following (consisting of the General Terms and Conditions and the Specific Terms and Conditions) between you and the Organiser (“Campaign Terms”). You agree that the Organiser may include additional terms to and/or vary the Campaign Terms at our sole discretion at any point of time and any additional and/or variation of the terms shall be incorporated by reference immediately at the point of time in which it is implemented.

In the event of any inconsistency between any terms and conditions stipulated in any of our marketing brochures, leaflets, buntings, or otherwise any other platforms and the Campaign Terms stipulated herein, the Campaign Terms shall prevail.

General Terms & Conditions

CAPACITY AND REPRESENTATION

• To participate in the Campaign, you must be aged eighteen (18) and above in Malaysia or have attained an age of majority in the jurisdiction in which you are domiciled to enter into legally binding contracts.
• You acknowledge and agree that all information made by you are true, accurate, and not misleading. We reserve the right to request for more information from you in the event we deem that the information provided by you is insufficient. Kindly note that failure by you to provide to us true and accurate information may result in your disqualification from the Campaign.
• You shall be responsible to update us immediately in the event that you discover that any information made by you is erroneous, outdated, or insufficient. Kindly note that failure by you to provide the necessary information to us may result in your disqualification from the Campaign.
• You further acknowledge that we will rely on any information provided by you and that any false, inaccurate, and/or misleading information may cause losses and damages to us. You agree to hold harmless and indemnify us, our directors, our employees, our agents, our affiliates, and any other third parties facilitating the campaign from the losses and damages suffered as a result of the false, inaccurate and/or misleading information provided by you.
• You shall not use the Campaign as a means or manner to facilitate any illegal and/or fraudulent transactions.
• You will not, by participation or entrance of this Campaign, violate any other terms and conditions, policies, and guidelines, and/or contracts that you have agreed to.
• You will comply with all applicable laws, by-laws, rules, regulations, policies, instructions, directions, orders and/or directives from us, any governmental organization, and/or relevant authorities.

PRIVACY

• All information provided by you shall be collected, stored, used and retained by us in accordance to our Personal Data Protection Act Notice. You are to read, acknowledge and accept our Personal Data Protection Act Notice which is incorporated by reference herein and can be found at https://staging.lbs.com.my/pdpa-notice/

TAX AND DISBURSEMENTS FEES

• You shall bear all transportation, personal expenses, insurance, stamp duties, transfer fees, taxes, any other duties and/or any other costs, fees and/or related expenses incurred pertaining to the , Vouchers, and Discount Vouchers.
• You shall be solely responsible to declare your Prize winnings with the relevant tax authorities and pay for any levy, duty, charges and tax that is imposed (if any). The Organiser shall not in any way be held liable to pay any charges, tax, levy, fines and/or duty that are imposed on the Winners by the relevant tax authorities for the Prize winnings.

PRIZES

• The Organiser shall not assume any liability and responsibility whatsoever in the event of any mishaps, injuries, damages, death, claims and/or accidents suffered by your participation in the Campaign and from the use of the Prizes.
• You shall hold the Organiser harmless against any liability and claims and agree to indemnify the Organiser completely for any claims, damages, losses and liability arising from and/or in relation to your use of the Prizes.
• You agree and acknowledge the Organiser provides no representation or warranty of any kind whatsoever in respect of any defect or other faults in relation to the Prize. The Organiser shall not be liable to compensate and/or rectify any defect or other faults in the Prizes. You shall contact and refer to the supplier, manufacturer, distributor and/or reseller of the Prizes in the event that you have any queries, concerns, and issues regarding the Prizes.
• Any decisions taken by the Organiser are final and binding on you. The Organiser shall not be obliged to entertain any queries, claims, requests or correspondences after the decision of the Organizer has been made.

INDEMNITY

• You agree to hold harmless and indemnify us, our directors, our employees, our agents, our affiliates, and any other third parties facilitating the campaign from any losses and damages suffered by us as a result of your violation or breach of the Campaign Terms.

PROMOTIONAL MATERIALS

You agree that the Organiser shall have the right to interview you, take photographs, and videos as well as use your personal details which shall include your name(s) for our marketing campaign materials for the purposes of advertising, trade and/or publicity without any prior notice, and permission to you. You acknowledge that any interview results, photographs and videos shall be solely owned by us.

MISCELLANEOUS

• Any representation of the Prizes shown in any advertisement and promotional materials are solely for illustration purpose and may defer from the actual prizes.
• The Organiser reserves the right at its sole discretion to suspend, modify, extend, delay or terminate the Campaign at any time without prior notice to you.
• Any decisions taken by the Organiser are final and binding on you and the Organiser shall not be obliged to entertain any queries, claims, requests or correspondences after the decision of the Organizer has been made.
• The Organiser shall have the absolute right to disqualify any individual that it determines to be tampering with and/or disrupting the operations of the Campaign, and/or to be acting in breach or potential breach of this Campaign Terms.
• Any provisions applicable to this Campaign which is prohibited or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions.

DISCLOSURE
This Campaign is in no way sponsored, endorsed or administered by, or associated with Facebook Inc. The Organisers expressly excludes any losses, claims, and/or actions arising from any glitch, malfunction, shut down, and/or otherwise use arising specifically from Facebook Inc or any platform (whether or not derivative) from Facebook Inc.

Specific Terms and Conditions

(1) Sales Gallery Viewing Incentive (“Viewing Incentive”)

Viewing Incentive Period

The Viewing Incentive will start from 12 March 2021, 12 a.m. and end on 15 March 2021, 11:59 p.m (“Contest Period”). The Organiser reserves the absolute right to extend or vary the Contest Period in its sole discretion. All entries received before and after the Contest Period shall be invalid and will not be entertained.

Viewing Incentive Details

To enter into the Viewing Incentive, you must be one of the first one hundred fifty (150) participants who has successfully complete the Online Registration Form via the hyperlink https://forms.gle/fSYLRBkNmhzc3A8w7 within the Contest Period.

You are entitled to submit more than one entry for the Viewing Incentive. However, you acknowledge and agree that submission of multiple entries will only entitle you to one Voucher under the Viewing Incentive.

Prizes

One (1) cash voucher worth up to Malaysian Ringgit One Hundred (RM100.00) from Aeon Co. (M) Sdn Bhd (“Vouchers”).

Prize & Redemption Details

All Vouchers shall be collected at LBS SkyLake Residence Sales Office (No. 3, Jalan Timur 9, D’ Island Residence, 47130 Puchong, Selangor, Malaysia).

The details of the redemption of the Vouchers will be communicated via the contact number submitted by you. Kindly note that the Voucher must be collected by 31 March 2021 (“Due Date”). Failure by you to collect the Vouchers by the Due Date shall disentitle you from redeeming the Vouchers.

Voucher winners are required to present his/her identity card (for verification purposes during redemption of the Vouchers). The Organiser reserves the right to request for further documents to verify your identity.

Vouchers winners may be required to take photocopy of their identity cards for verification purposes and send it to the email address of the Organiser at [email protected] or by way of a physical copy to complete the redemption of the Vouchers. Failure to do the aforementioned might disentitle you from claiming the Vouchers. The Organiser reserves the right to request for further documents to verify your identity. Notwithstanding the Privacy clause in the General Terms and Conditions, you agree and consent to the collection of the photocopy of your identity card for the purposes of verification under the Viewing Incentive campaign that will be processed by the Organiser in accordance to the relevant provisions of the Malaysian Personal Data Protection Act 2010.

Facebook Live Giveaway Event (“Facebook Giveaway Contest”)

Contest Period

The Facebook Live Giveaway Contest will start between 13 March 2021, 2 p.m. to 13 March 2021, 3 p.m. (“Contest Period”). The Organiser reserves the absolute right to extend or vary the Contest Period in its sole discretion. .

Contest Details

To enter into the Facebook Live Giveaway Contest, you must be;

a) female (in accordance to your identity card); and
b) one of the fifty (50) participants who has successfully entered, ‘liked’, ‘shared’ the Facebook Live stream on 13 March 2021 at 2p.m. and answered the questions accurately posted by the Organizer.

You are entitled to submit more than one entry for the Facebook Live Giveaway Contest. However, you acknowledge and agree that submission of multiple entries will only entitle you to one Voucher under the Facebook Live Giveaway Contest.

Prize & Redemption Details

One (1) discount voucher for Societe Francaise De Cosmetiques Sdn Bhd (Sothys Malaysia) worth Malaysian Ringgit Three Hundred and Twenty (RM320.00) (“Discount Voucher”).

The details of the redemption of the Vouchers will be communicated via Facebook Direct Message and you are required to provide your personal details such as your full name, identity card number, contact/mobile phone number, email address (“Personal Details”) for verification by responding to the Facebook Direct Message within five (5) working days of receiving the message. Kindly note that if you do not provide your Personal Details within five (5) working days from the date of sending of the Facebook Direct Message, the Discount Voucher shall be forfeited by us and you are forthwith disentitled from redeeming the Discount Voucher.

All Discount Vouchers will be emailed out to the email address provided by you to us in the preceding paragraph.

Discount Vouchers winners may be required to take photocopy their identity cards for verification purposes and send it to the email address of the Organiser at [email protected] to complete the redemption of the Discount Vouchers. Failure to do the aforementioned might disentitle you from claiming the Discount Vouchers. The Organiser reserves the right to request for further documents to verify your identity. Notwithstanding the Privacy clause in the General Terms and Conditions, you agree and consent to the collection of the photocopy of your identity card for the purposes of verification under the Facebook Live Giveaway Contest that will be processed by the Organiser in accordance to the relevant provisions of the Malaysian Personal Data Protection Act 2010.

LBS SkyLake Residence Purchase Incentives Campaign (“Incentive Campaign”)

Contest Period

The Incentive Campaign will start between 12 March 2021, 12 a.m. until 15 March 2021, 11.59 p.m.. (“Contest Period”). The Organiser reserves the absolute right to extend or vary the Contest Period in its sole discretion. All entries received before and after the Contest Period shall be invalid and will not be entertained.

The Incentive Campaign is open to purchasers who are interested to purchase the selected units at LBS SkyLake Residence developed by the Organiser (“LBS SkyLake Residence”) further detailed below.

Contest Details

To enter into the Incentive Campaign, you and/or the recommended purchaser pursuant to Prize and Redemption Details for the Incentive Campaign below, must;

• Have successfully completed the Online Registration Form via the hyperlink https://forms.gle/fSYLRBkNmhzc3A8w7 within the Contest Period (applicable for female participants);
• Have successfully completed the Booking Form (which will be provided by us to you at a later date) and paid the necessary booking fees; (applicable for female participants or the recommended purchaser)
• Have executed and stamped a valid Sale & Purchase Agreement, and with the Organiser and/or its related companies (“SPA”) wherein the purchase price of the LBS SkyLake Residence unit shall be above RM300,000.00 between 12 March 2021 to 31 March 2021 as well as paid the first instalment of the purchase price of the LBS SkyLake Residence unit in accordance to the Third Schedule of the SPA (excluding the first ten percent (10%) of the purchase price of the LBS SkyLake Residence unit rebated by the Organiser). (applicable for female participants or the recommended purchaser)
• In the event that you are to buy the unit in the LBS SkyLake Residence as a cash buyer, you shall have executed and stamped a valid Sale & Purchase Agreement wherein the purchase price of the LBS SkyLake Residence unit shall be above RM300,000.00 and you have paid twenty percent (applicable for female participants or the recommended purchaser)
• Have not defaulted and/or breached any provisions of the SPA (applicable for female participants or the recommended purchaser);

Prize and Redemption Details

(a) One (1) coffee machine (male and female participants); and

(b) Malaysian Ringgit Eight Hundred and eighty-eight (RM888) cash (female participants or the recommended purchaser of the LBS SkyLake Residence by the same female participant)

(collectively “Prize”).

• The Organiser shall notify you of the Prize redemption arrangements and collection due date via the contact number provided by you and by way of phone call (“Prize Collection Notice”).

Prize winners are required to present his/her Malaysian identity card (as per the National Registration Act 1959) for verification purposes during redemption of the Prize. The Organiser reserves the right to request for further documents to verify your identity.

The coffee machine shall not be nominated or assigned to any third-party and/or be exchangeable for cash.

For the avoidance of doubt, in the event that the SPA and/or Facilities/Loan Agreement is signed in joint names, all the names in the SPA shall be treated as one single participant for the purposes of the Incentive Campaign.

DISQUALIFICATION

In the event the SPA is treated as repudiated and terminated by the Organiser and/or you default on any payment due and payable under the SPA for any reason whatsoever, we shall be entitled to request for payment of the market retain purchase price of the coffee machine within seven (7) days from our written demand to you.

The Organiser reserves the right to initiate legal action against you for the retail price of the Prize, in the event that you fail to make the payment stated above.
